
Extortion
(1) A public official who, by abusing the influence derived from his or her position, induces a person to provide or promise a benefit to himself or herself or to another person shall be punished by imprisonment for a term of five to ten years. If, in the face of a public official’s unjust conduct or behavior, a person provides a benefit to the public official or to a person directed by the official out of the legitimate fear that the official’s duty will not be performed at all or at least not in a timely manner, the existence of extortion shall be taken into account.
(2) A public official who, by abusing the trust conferred by their office through fraudulent conduct, persuades a person to provide a benefit to themselves or another person or to make a promise, shall be punished by imprisonment for a term of three to five years.
(3) If the offense defined in the second paragraph is committed by exploiting a person’s vulnerability, a prison sentence of one to three years shall be imposed. (4
) Taking into account the value of the benefit and the victim’s economic circumstances, the sentence to be imposed pursuant to the preceding paragraphs may be reduced by half.
