The decision rendered by the local court at the conclusion of the case between the parties, as indicated by the date and number above, was determined by the plaintiff (male) regarding the finding of fault, compensation, and alimony awarded to the woman; the defendant (female), however, reviewed the document, debated it, and assessed the necessity of objecting to its entirety: In the petition;
it is necessary to provide clear summaries of all matters forming the basis of the plaintiff’s claim under serial numbers (CMK Article 119/1-e). The court cannot automatically review facts not properly relied upon by the plaintiff. The cause of action and the facts must be presented in a clear and concrete manner appropriate to the opposing party’s defense. Furthermore, the defendant’s fault-based conduct warranting divorce has not been proven. Given the current circumstances, while the case should have been dismissed, it was determined that accepting the case in writing and annulling it was incorrect.
CONCLUSION: For the reasons stated above, it has been unanimously decided to REVERSE the appealed decision; there is no basis to review the plaintiff’s appeals based on the grounds for reversal; the appeal fee will be refunded to those who paid it upon request within 15 days of the service of this decision, and an opportunity for correction will be provided.
