What Is a Preliminary Attachment

A provisional attachment is a court order issued to prevent the debtor from transferring their assets to third parties, thereby preventing the transfer of such assets to third parties. In particular, in commercial activities based on negotiable instruments (checks, bonds), if those liable for the debt become unable to pay, relevant legislation permits the creditor to initiate a seizure proceeding on the property in exchange for certain collateral to expedite the collection process.
