Conditions for Precautionary Seizure:
If the creditor’s claims are past due and there is no collateral (due to the broad scope of this condition, a precautionary seizure order may be issued against debtors with large amounts of debt based on promissory notes, even if there is no risk of flight);
If the creditor’s claims have not yet matured, but any of the following points is proven: The debtor
has no specific payment plan;
The debtor is preparing to hide or dispose of assets to evade obligations;
The debtor is preparing to flee or has already fled;
The debtor has engaged in acts that violate the creditor’s rights for this purpose. It is sufficient for the creditor
to present evidence to the court regarding the existence of grounds for provisional attachment; full proof is not required.
