Explanations:
An enforcement proceeding without a court order, file number 2021/…, has been initiated against our client …….. by your Directorate. The order for payment without a court order was personally served on our client on …/…/…. Our client has no debt to the creditor. The debt subject to the enforcement proceedings initiated by the creditor was paid by our client to the creditor three months ago. Therefore, we object to the enforcement proceedings initiated by the creditor, the debt subject to the proceedings, the interest, and all other consequences.
Furthermore, the signature on the document forming the basis of the enforcement proceedings initiated by the creditor and served on our client as an attachment to the payment order does not belong to our client. We express our objection to the signature in clear and unequivocal terms.
Request and Conclusion: As explained above, we object to the payment order without a court order sent to our client as a result of the enforcement proceedings initiated by the creditor against our client. We object to the principal debt, interest, and all other charges specified in the payment order, as well as to our client’s signature on the document attached to the payment order. We respectfully request that the enforcement proceedings in question be suspended and that the necessary other actions be taken.
