Execution and Bankruptcy Offense – Withdrawal from Auction to Provide Benefits

In case of withdrawal from the auction for the purpose of providing benefits, the person who does not participate in the auction or subsequently withdraws from the auction in exchange for the promise to provide the benefits or benefits provided to him or someone else in the auction will be punished. In addition, intermediaries who participate in this crime by mediating the tender shall also be punished according to the same provision of the law.

In order for the crime of withdrawal from the tender to occur, a tender must have been made by the enforcement directorate and an interest must have been provided or promised to the defendant to participate in this tender or withdraw from the tender for enforcement crimes.

The prosecution of the crime depends on the complaint and the complaint must have been filed by the creditor, debtor or related third parties.

The court dealing with these enforcement crimes is the Enforcement Criminal Court, and these cases cannot be combined with criminal cases in other courts. The competent court in terms of crime is the court to which the enforcement office is affiliated, where enforcement proceedings are conducted.
