In these execution crimes, the prosecution depends on the complaint and a lawsuit is filed at the Execution Criminal Court, which is the competent court on behalf of the person who committed the crime. The competent court for this crime is the court of the place where the real estate is located or the court of the place where the crime was committed.
In order for a crime to occur, the borrower must steal or store the item that entitles the lessor to imprisonment, the borrower must smuggle or store the item kept in the ledger, the borrower or a third party must occupy or have occupied the place that is requested to be vacated in such a way as to harm the lessor.
