
The Crime of Execution and Bankruptcy- Withdrawal without Increasing To Benefit
In the crime of withdrawing from an increase in order to provide benefits, a person who does not participate in the increase in exchange for a promise to provide benefits or benefits provided to him or someone else in tenders, or withdraws later from the increase, is punished. In addition, intermediaries who contribute to this crime by acting as intermediaries in tenders will be punished in accordance with the same provision of the law.
In order for the crime of withdrawal from the increase to benefit to occur, there must be a tender made by the Enforcement directorate, and the defendant must have been provided with a benefit or promised not to participate in this tender or withdraw from the tender for enforcement offenses.
The follow-up of the crime depends on the complaint; a complaint must be filed by the creditor, debtor or related third parties.
The court charged with these enforcement offenses is the Enforcement Criminal Court, and these cases cannot be combined with criminal cases heard in other courts. The competent court in terms of crime is the court to which the enforcement office is attached, where the enforcement proceedings are carried out.
