Execution Crimes According to the Execution and Bankruptcy Code

Enforcement offenses are regulated in the Enforcement and Bankruptcy Code. Creditors who cannot collect their receivables from the debtor have the right to collect their receivables forcibly with the help of the state. In order for the forced execution regulated in the Execution and Bankruptcy Code to be effective, some obligations have also been imposed on the debtor in the law. If the debtor does not fulfill these obligations in the manner prescribed by law, sanctions are also organized under the name of enforcement offenses.

The enforcement offenses included in the law, in order, are as follows;

1- Reducing Its Existence with the Intention of Putting its Creditor at a Loss (m. 331)

2- The One Who Causes His Weakness with His Own Act or Aggravates the Evil of His Situation by Knowing (m. 332)

3-Providing Personal Benefits in Bankruptcy and Concordat Affairs (m. 333)

4- Those Who have the Authority of Management in Trading Companies, With the Intention of Putting Creditors into Harm, Do Not Pay the Debts of the Commercial Enterprise, Thereby Putting Creditors into Harm (m. 333/a)

5-Do not mistake the Authorized Persons in the Concordat (m. 334)

6- The Abduction of the Goods on Which the Lessor is Imprisoned and the Occupation of the Place that Needs to be Evacuated by Someone Else (m. 335)

7-Not to Give the Mufti’s Property to the Bankruptcy Administration and Not to Inform the Mufti of His Receivables (m. 336)

8- Failure to Declare Property (m. 337/1)

9-Failure to Deliver the Requested Goods, Failure to be Present While Keeping the Books, Failure to Comply with the Orders of the Bankruptcy Administration (m. 337/2)

10- Acting Contrary to the Provisions of Abandonment of Trade (m. 337/a)

11- Making a Statement Contrary to the Truth (m. 338)

12- Failure to Report the Increase in Goods and Earnings After the Declaration of Goods (m. 339)

13- Breach of Commitment (m. 340)

14- Avoiding the Delivery of Children (m. 341)

15- Re-Entry into the Immovable and Ship Delivered by Decree (m. 342)

16- Resisting the Execution of the Provisions of the Judgment (m. 343)

17- Failure to Pay Alimony Debt (m. 344)

18- Not to Request the Bankruptcy of the Capital Company even if it is Necessary (m.345/a)

19- Withdrawal from the Increase in Order to Benefit (m.345/b)
