A person who has suffered damage or is in danger of harm as a result of the immovable owner’s use of his property right in violation of the legal restrictions of this right may sue for the restoration of the situation, the elimination of the danger and damage he has suffered. The owner of the immovable property is responsible for all property. The injured neighbor must be the owner of real estate or persons who have property based on a personal right such as a limited real right or rent.
This state of responsibility is provided by Article 70 of the Law No. 6098.in its article, ‘ A person who is in danger of being damaged by a building or other building works belonging to another person may ask the rightful owners to take the necessary measures to eliminate this danger.
