
Execution and Bankruptcy Offense – Failure to Give the Mufti’s Property to the Bankruptcy Administration and Not to Inform the Mufti of the Receivables
The crime of not giving the property of the müfli to the bankruptcy administration and not notifying the creditors of the müfli may be committed by third parties who hold the property of the müfli or are indebted to the müfli. If these persons do not hand over their property to the bankruptcy administration within one month of learning of the announcement that the bankruptcy has been opened or do not report their debts, enforcement offenses will occur.
Enforcement crimes are followed up on a complaint and the complaint must be made within three months and probably within a year from the day the crime is learned.
The court charged with the crime of not giving the property of the müfli to the bankruptcy administration and not notifying the creditors of the müfli is the Enforcement Criminal Court. However, in the event of an appeal against the criminal decree, the High Criminal Court will be the court in charge. If the courts are authorized in terms of enforcement offenses, the place where the prosecution is carried out is the Enforcement Criminal Court or the Enforcement Criminal Court where the debtor’s processing center is located.
