Interim Measures Under the Code of Civil Procedure

HMK 389. In the current situation, if concerns arise that difficulties or impossibility may arise due to mental delay or serious harm resulting from a change that could occur essentially or entirely in the wrong hands, a concern emerges that the court may issue an order for a preliminary injunction. Individuals claiming that their personal rights have been violated by published content may reapply to the courts for an injunction to block access. However, there is a “principle of proportionality” that courts must consider when issuing an injunction to block access. If the measure applied causes harm to many people in addition to the interests it seeks to protect, the decision is not proportionate, and an access restriction order should not be issued in such cases.
