
What is Precautionary Alimony?
Precautionary alimony is a temporary measure; it is an alimony that spouses can claim during divorce proceedings or before divorce proceedings, especially to cover the housing, subsistence and maintenance costs of their children. Precautionary alimony can be given in favor of both spouses and children. Unlike poverty alimony, although there is no request from individuals, the judge may decide on precautionary alimony if he deems it necessary. Precautionary alimony can also be requested through an independent lawsuit (separation lawsuit) without filing a divorce lawsuit.
In this case, the person must prove that his separation from his wife is based on justified reasons. Both in the divorce case and in the separation case, alimony begins to process from the date of the case. Precautionary alimony is intended to provide temporary protection. It ends spontaneously with the finalization of the divorce decision or the expiration of the separation period (the separation decision can be made for a maximum of 3 years). Finally, unlike poverty child support, the defect rates of the parties are not taken into account when determining child support.
