
WHAT IS POVERTY ALIMONY?
It is a type of alimony that the spouse who will fall into poverty due to divorce can request from the other spouse in order to maintain his/her livelihood and the life he/she leads. The spouse requesting alimony should not be more seriously at fault than the other spouse in the divorce. Again, in case of equal fault, poverty alimony can be requested in the presence of other conditions. Poverty alimony is paid once or every month to the former spouse who falls into poverty after the divorce decision is finalized. This alimony can also be requested with a separate lawsuit after the divorce case.
However, if the divorce is an uncontested divorce and poverty alimony is not requested in the protocol, poverty alimony cannot be requested through a separate lawsuit. A common belief among the public is that working people cannot receive alimony. This is true in a way; however, there are cases where alimony can be granted to people who had high standards during the marriage, but who will experience serious difficulties after the divorce despite working. There are decisions of the Court of Cassation on this issue. The law states that alimony can be granted “indefinitely”; however, it cannot always be granted indefinitely.
