What Is Effective Remorse and Which Provision of the Law Does It Cover

Effective Repentance

Article 168 –
In cases of theft, vandalism, breach of trust, fraud, fraudulent bankruptcy, negligence, and crimes committed prior to the initiation of prosecution following the completion of bankruptcy proceedings, if the perpetrator, victim, or accomplice demonstrates that full orders have been issued for the compensation or restitution of damages, a reduction of approximately two-thirds of the imposed sentence shall be applied.

(2) If effective remorse is demonstrated after the commencement of the trial but before a judgment is rendered, the sentence may be reduced by up to half.

(3) The sentence to be imposed on a person who demonstrates effective remorse for the crime of robbery shall be reduced by half in cases falling under the first paragraph and by one-third in cases falling under the second paragraph.

(4) In cases of partial restitution or compensation, the victim’s consent is also required for the provisions on effective remorse to apply.
