INSTRUCTIONS

1-) The defendant … …. , on …/ …/ …, intercepted our client on his way to school, stating that his father had been in an accident at work and was currently in the hospital, that he would take him to his father’s hospital, that he was his father’s colleague, and that his father had already sent him.

2-) Our client is still … years old. Although he is under the age of fifteen, he was not in a position to realize that he was being deceived due to the anxiety he was experiencing at the time. Therefore, he believed what the defendant said and got into the defendant’s car under the pretext of being taken to the hospital.

The defendant parked the car in his own province, locked it, and began to approach our client. Although our client constantly pushed and resisted the defendant, he could not escape. During the struggle, our client hit his head on the glove compartment and fainted. Taking advantage of this opportunity, the defendant sexually assaulted our client repeatedly.

4-) A few hours after the incident, the defendant left our client near her home in a semi-conscious state and threatened her before leaving, saying, “If you tell your mother or father about this, I will do ten times worse, I did nothing more than this, and I will also cut their throats.”

5-) Due to the fear and distress she experienced, our client did not tell her family about this for a long time, but one day, when her mother pressed her, the situation came to light.

6-) Since the lawsuit filed by the defendant against our client constitutes a crime under Article 103 of Turkish Criminal Code No. 5237, it has become mandatory to file a complaint.

CONCLUSION AND RECOMMENDATION: For the reasons explained above, we request that a decision be made to open a public case against the suspect, on whose behalf we are acting, to investigate and punish him. …/…/….
