Types of Legal Rules

1- MANDATORY LEGAL RULES: A legal rule commands that something be done or not done.

These are rules that will lead to legal sanctions when an act occurs.

2- SUPPLEMENTARY LEGAL RULES: The parties have agreed on the primary points in the contract they have signed, but have not regulated other elements of the contract. In this case, the legal rules governing the remaining matters

are called supplementary legal rules. For example,

couples are not required to comply with the principles of the. Civil Code regarding the division of property; however,

in the event of a dispute, the relevant provisions of the. Civil Code come into play.

3- INTERPRETATION OF LEGAL RULES: This is a concept used in legislation or in contracts between parties.

These provisions explain in more detail what they actually mean. For example, in a lease agreement,

it is stipulated that the rent shall be paid in the middle of the month. However, what does the term “middle of the month” mean in the contract?

It is not specified. In such cases, interpretive legal rules come into play. Accordingly, the term “middle of the month”

is understood to mean the 15th day of the month.

4-DEFINITIVE LEGAL RULES: What defines a legal concept and what should be understood by this concept?

These are legal rules that indicate a settlement requirement, such as in the TMC. According to M.19, “Settlement is the place where a person resides with the intention of staying permanently.”
