Prisoners Who Cannot Benefit from Parole Provisions

In certain circumstances, convicts are not eligible for parole.
Conditional release provisions cannot be applied in the following cases:

Convicts are not conditionally released if repeat provisions are applied for the second time (5275 m.108/3).
Convicts whose death sentences have been converted to prison sentences pursuant to Law No. 4771 are not eligible for conditional release provisions.
-The Fourth Section of the Second Book of the Turkish Penal Code No. 5237, the Fourth Section titled “Crimes Against State Security,” the Fifth Section titled “Crimes Against the Constitutional Order and the Functioning of this Order,” and the Sixth Section titled “Crimes Against National Defense.” If the crime is committed within the framework of an organization’s activities, the provisions on conditional release do not apply in cases of “aggravated life imprisonment” (Article 107/16 of Law No. 5275).
