Constantly talking about your ex-lover after getting married, saying to your spouse, “I wish I had married my ex-lover, I would have been happier with him/her, I regret marrying you, I miss my ex-lover,” is considered a flaw. Because married life can only continue with mutual love and respect. Words or behaviors that shake the foundations of shared life can cause incompatibility to the extent that it prevents the continuation of the relationship. You can review the following Supreme Court Decision example, which is one of many examples related to this issue.
“Text of Justice”
COURT: Family Court
CASE TYPE: Mutual Divorce
Supreme Court 2nd Civil Chamber
Case Number: 2016/10455
Decision Number: 2018/1541
The judgment rendered by the local court at the conclusion of the proceedings between the parties, the date and number of which are indicated above, was appealed by the defendant-plaintiff man in both cases, and the minutes were read, the matter was discussed, and a decision was reached:
The court ruled that the defendant-plaintiff man’s
petition for divorce was rejected, the plaintiff-defendant woman’s petition was accepted, and the defendant -defendant man was found to be at fault for undermining the foundation of the marriage, and the parties were granted a divorce. However, from the trial and the evidence gathered, it is understood that the defendant-plaintiff woman frequently mentioned her ex-boyfriend, regretted marrying her husband, and said that she would have been happier if she had married her ex-boyfriend.
In this case, there is a dispute that fundamentally undermines the parties’ shared life and prevents the continuation of the union. In light of the circumstances, the defendant-plaintiff man has the right to file a lawsuit. This case, while the man’s divorce case should have been accepted, the dismissal of the case was deemed inappropriate due to insufficient grounds.
CONCLUSION:
Based on the aforementioned grounds, the plaintiff-defendant woman, whose case must be retried, has been sentenced to an EXCESSIVE FINE due to her other appeals regarding the divorce case and the temporary ancillary provisions of the divorce. The decision was made unanimously within 15 days of the notification of the appeal, with the possibility of correction. February 7, 2018 (Wednesday)
