EXPLANATIONS:
1-) Our client graduated from the Faculty of Law of …. University in …. After completing his undergraduate education, he applied to the defendant administration on …/…/… for equivalence of his diploma, but his application was rejected on the grounds that his period of stay abroad was insufficient. (ATTACHMENTS 1-2-3)
2-) Under Article 7(p) of the Higher Education Law No. 2547, “determining the equivalence of associate, bachelor’s, and graduate degrees obtained from higher education institutions abroad” is listed among the duties of the Higher Education Council.
Additionally, Article 5 titled “Recognition of Higher Education Institutions and Programs,” Article 6 titled “Review of Graduation Recognition Certificates and Diploma Equivalency Applications,” and Article 7 titled “Regulation on the Recognition and Equivalence of Higher Education Diplomas Abroad,” and Article 7 titled “Procedures to be Followed Following the Review of Graduation Recognition Certificates and Diploma Equivalence Applications” clarify the procedures to be followed in recognition and equivalence processes.

Each country has its own legal rules, and the education provided is based on the rules applied in the country where the university is located. The diploma obtained from the university where the undergraduate education was completed will be used in the field of law in Turkey upon approval of its equivalence. The documents supporting our client’s application for equivalence to the Higher Education Council’s Legal Equivalence Sub-Committee must be individually reviewed by faculty members specializing in the field, and the required courses must be determined and reported. There is no legal basis for the defendant administration to reject our client’s application on the grounds that their period of stay abroad was insufficient without examining whether they took courses specific to Turkish law. Additionally, it will be understood from the passport transcripts attached to our petition that our client continued their education as required. (Appendix 4)
4-) In light of the above explanations, it has become necessary to file this lawsuit due to the rejection of the application for the issuance of an equivalency certificate.
