SUBJECT: Submission of our objections to the 103rd summons.
EXPLANATIONS:
1-) In the invitation letter sent to us regarding the seizure procedure carried out at the address on …/…/… within the scope of the above-mentioned file, the person named (K) is listed as the creditor of the file. However, the creditor of the file is the person named (L).
2-) Additionally, since the summons states that a seizure has been imposed, the vehicles with license plate number XXX mentioned in the information are registered under the name of (A) and not under the name of (B).
3-) Under Article 103 of the Enforcement and Bankruptcy Law No. 2004;
“If, during the preparation of the record, the creditor, debtor, or a person authorized to serve notice in accordance with the provisions of the Notification Law on their behalf cannot be found, the absent creditor or debtor shall be summoned to the enforcement office within three days to review the record and state their case. The periods required by law shall remain reserved. If there is a person authorized to serve notice on behalf of the debtor or creditor in accordance with the provisions of the Notification Law during the seizure, a copy of the seizure record is given to the person holding it. No additional notice is served on the debtor or creditor.
The regulation is as follows.
