
Execution Offences According to the Execution and Bankruptcy Law
Enforcement offences are regulated in the Enforcement and Bankruptcy Code. Creditors who cannot collect their receivables from the debtor have the right to collect their receivables by force with the help of the state. In order for the enforcement of cebr-i, which is regulated in the Enforcement and Bankruptcy Code, to be valid, some obligations are also imposed on the debtor in the law. In case the debtor fails to fulfill these obligations as stipulated by the law, sanctions have also been introduced under the name of execution crimes.
The execution crimes counted in the law are as follows, respectively;
1- Reducing Its Assets in Order to Reduce its Creditor to a Loss (m. 331)
2- He Who, by His Own Act, Causes Someone’s Suffering or Intentionally Increases the Evil of His Situation (m. 332)
3-Provision of Personal Benefit in Bankruptcy and Concordat Cases (m. 333)
4-To Put Creditors in Difficulty by Not Paying the Debts of the Commercial Enterprise and to Put Creditors of Those Who Have Management Authority in Commercial Companies into Difficulty (m. 333/a)
5-Do not Mislead the Authorities in the Concordat (m. 334)
6- The Goods on Which the Lessor Has the Right to Imprisonment Must Be Smuggled And Occupied by Someone Else at the Place Where They Should Be Removed (m. 335)
7-Not to Give the Mufli’s Property to the Bankruptcy. Administration and Not to Inform the Mufli’s Receivables (m. 336)
8- Failure to Declare the Goods (m. 337/1)
9-Failure to Deliver the Requested Goods, Failure to be Present in Accounting Transactions, Failure to Comply with the Orders of the Bankruptcy Administration (m. 337/2)
10-Violation of the Provisions of Abandonment from Trade (m. 337/a)
11- To Say a Word Contrary to the Truth (m. 338)
12- The Fact that the Increase in Goods and Earnings is Not Reported After the Declaration of Goods (m. 339)
13- Violation of the Debt (m. 340)
14- Avoidance of Child Birth (m. 341)
15- Re-Entry of Immovable Property and Ships Delivered by Decree (m. 342)
16- Opposition to the Implementation of the Provisions of the Decree (m. 343)
17- Non-Payment of Child Support Payable (m. 344)
18- Failure to Request the Bankruptcy of the Capital Company when Necessary (m.345/a)
19- Withdrawal from the Auction for Benefit (m.345/b)
