
WHEN THE CASE WAS FILED WILL BE EVALUATED
The Law stipulates that the lawsuit shall be deemed to have been filed on the date of registration of the statement of claim (Art. 188/1) and regulates that the principles and procedures regarding the registration of the statement of claim shall be determined by the Regulation.
Article 36 of the Regulation envisages various possibilities in this regard. Accordingly, the lawsuit is deemed to have been filed on the date the petition is submitted and registered (electronically, in UYAP).
If, for any reason, it is not possible to make an electronic transaction (transfer); if the transaction is made in a physical environment, this situation is determined with a report; with the opening of the electronic system, the transactions made in the physical environment are transferred to the electronic environment without delay, and in this case, the lawsuit is deemed to have been filed on the date this report is issued.
If the lawsuit is filed with an electronic signature through the UYAP system and the judicial fees and expenses are transferred to the court teller’s account electronically or provided by payment instruments such as bar card, credit card, etc., the lawsuit shall be deemed filed on the date the lawsuit petition is registered in the UYAP System.
