What is the Scope of the Inheritance Certificate

An inheritance certificate is a document that determines the inheritance. In addition, the shares of the heirs, i.e. the inheritance rights and shares of the beneficiary of the inheritance, and the shares of the other heirs are also written down. Not all heirs have to request this to be written down.

The heir who receives the certificate of heirship is authorized to claim and collect the receivables of the heir’s inheritance property, to register the immovables in the inheritance to the land registry and to perform other similar transactions. According to the decisions of the Court of Cassation, the heir must submit a certificate of inheritance in order to exercise inherited rights. For example, the bank where the heir deposited the money of the heir seeks a certificate of inheritance in order to deliver it to the heir.
