
WHAT IS AN EXECUTION DEMAND?
If a claim is made on the pledge, it is written in the pledge record by the sequestration officer. If the situation was not learned during the pledge, a claim for compensation must be filed within seven days from the date the pledge was learned. A if claim for compensation is made in this way, the situation shall be notified to the creditor by the enforcement office. If the creditor does not object within three days, the pledge is removed. These deadlines should be taken into consideration as they damage the rights.
If the debtor or creditor objects to the request made by the third party within three days, the enforcement directorate must immediately send the file in question to the enforcement court. The enforcement court evaluates the compensation claim through the file before it. In this evaluation, it is examined whether the claim for compensation is real, sincere and convincing. The court also considers whether the claim for compensation is made solely for the purpose of preventing the foreclosure from taking place. The period for filing a lawsuit starts with the notification of the decision of the execution court to the third party claiming compensation.
