Foreclosure and expert examination in traffic accidents
Article 83 – Traffic accidents;
a) To the local general law enforcement authorities in order to carry out the necessary judicial procedures,
b) It is confiscated by the traffic police in order to determine the causes, traces and evidence of the accident and to organize a traffic accident report.
In accidents that occur on highways where the traffic police are not on duty or are not present, the traffic accident report is issued by the local municipal police and a sample of it is sent to the traffic police of that place.
In traffic accidents that occur on highways and result only in material damage, if the agreement of the parties and the act does not constitute another crime, judicial prosecution is not carried out and the provision of Article 565 of the Turkish Penal Code is not applied.
If the road is closed to traffic in traffic accidents, the traffic police or gendarmerie is authorized to open the road to traffic after marking the traces and evidence in such a way that they are not lost and taking the necessary actions.
When it is understood that the closure of the highway to traffic leads to fatal and life-threatening injuries, this accident affects life, property and traffic safety, and if it is understood that there is no other way to pass, the necessary markings are made, the vehicle and the deceased are pulled over and the road is closed to traffic after the situation is determined by a report. it opens.
Traffic policemen shall act as expert witnesses in traffic accidents if they are assigned according to the procedural laws.
