Within the scope of the investigation file numbered 2023/… of the Silivri Chief Public Prosecutor’s Office, the Silivri Criminal Court of Peace has made a judicial control decision in the form of a signature requirement one day a week with the decision dated …/…/2023. And numbered 2023/… query. The decision in question is unlawful and should be lifted upon appeal. And the suspect should be released unconditionally. As follows;
The suspect made sincere statements and told the facts both in his statement at the prosecutor’s office and in his interrogation at the criminal court of peace. It is clear that no criminal elements have been formed about the suspect and the crime subject to investigation has not been committed by the suspect.
In addition, the suspect’s residence is fixed and there is no possibility of escape. Given that the suspect is not in danger of obscuring the evidence, the obligation to sign one day a week imposed on the suspect causes our client’s victimization. For these reasons, the judicial control measure by signature. Which is a measure restricting the freedom of the suspect. Is an excessive measure and it has become mandatory to request its removal by appeal.
