EVENTS :
1- The plaintiff client is owner of real estate registered in the title deed ….., …….’is. The parcel number. The defendant is also the owner of the immovable property adjacent to the plaintiff’s plot.
2- The plaintiff client used part of the defendant’s plot unwittingly. And unwittingly while building a building on his own plot. This issue arose after the defendant objected after the completion of the construction and made the boundary determination to the cadastre officer.
3- Since there has not been a fixed boundary between the immovables of the parties for many years, the plaintiff has unintentionally encroached on the neighboring parcel. Dec. But the value of the building is much higher than the value of the part that was raped. Just as the destruction of the structure would not be in accordance with equity. It is much more than the value of the violated part. Just as the demolition of the structure will not be in accordance with justice. The abandonment of the raped part will not prevent the defendant from using the real estate.
4- For this reason, we demand that the ownership of the part of the immovable property belonging to the defendant, where the part encroaching on the construction is located, be given to the plaintiff in exchange for an appropriate price.
