
The jurisdiction of the Assize Courts is regulated in Article 12 of the Law No. 5235, and whether a crime committed is a crime falling within the jurisdiction of the Assize Court is determined by taking into account the criteria introduced in Article 12 of this article, i.e. the nature and amount of the crime. In addition, crimes that are not explicitly stated to fall within the jurisdiction of the Assize Court are also heard by the Criminal Courts of First Instance.
Serious Criminal Courts are generally assigned to crimes punishable by imprisonment of 10 years or less, and there are 3 main criteria for crimes falling within the jurisdiction of the Serious Criminal Courts:
Without prejudice to the cases where a separate duty is assigned by law,
Major crimes:
The crime of plunder (extortion) (Art. 148, 149 TPC),
The crime of extortion (Art. 250/1 and 2 TPC),
Forgery of official documents (Article 204/2 of the TPC),
Qualified fraud offense (Article 158 of the TPC),
Fraudulent bankruptcy offense (Art. 161 TPC),
Crimes against the Security of the State (302.303.304.304.305.305.305.306.307.308),
Offenses against the constitutional order and its functioning (309.310.311.312.313.313.314.315.316),
Crimes against national defense (except Articles 318, 319, 324, 325 and 332),
Crimes against state secrets and espionage (326,327,328,329,329,330,331,332,333,334,335,336,336,337,338,339),
Offenses falling within the scope of the Anti-Terrorism Law No. 3713.
Crimes punishable by aggravated life imprisonment, life imprisonment and imprisonment for more than ten years;
The offense of voluntary manslaughter (Art. 81, 82 TPC),
The offense of grievous bodily harm (Art. 87/4 TPC),
Causing death by negligence (Article 85/2 of the TPC),
The crime of embezzlement (Art. 247 TPC),
A target timeframe of between 300 and 390 days has been set for the conclusion of cases in these courts.
