
Execution and Bankruptcy Offense – Violation of the Provisions of Abandonment of Trade
In terms of the crime of violating the provisions of abandonment of trade, the debtor must be a trader. In addition, this merchant debtor has TWO m’s.44 must not have notified the trade registry that he has abandoned the trade by not fulfilling the requirements of the provision, or he must have never submitted a declaration of goods or submitted a declaration of missing goods. However, in the law, only these behaviors of the debtor merchant were not considered sufficient for the occurrence of enforcement offenses, and in addition, the condition that the creditor will be harmed by these acts of the debtor was sought.
Since the crime of violating the provisions of abandonment of trade is a complaint-related crime, of course, the creditor’s complaint is important in terms of enforcement proceedings.
