PROVISION: 156/1, 50/1-a, 52/2-4 OF THE Turkish Commercial Code. conviction in accordance with the articles
The verdict on the conviction of the defendant for the crime of using free stock was appealed by the defendant, the file was examined and considered as necessary;
34 of the Law No. 6763, which entered into force on the same date by publishing it in the Official Gazette No. 29906 dated 02.12.2016 after the verdict on the public lawsuit filed for the crime of using free shares charged to the accused. article 253 of the CMK No. 5271. and 254. considering that the articles of the agreement have been made, settlement transactions have been made in accordance with the new regulation, and as a result, there is an obligation to assess and determine the defendant’s legal status,
Since the appeals of the accused were considered in place as of this moment, the decision was therefore made in accordance with Section 8/1 of Law No. 5320. article 321 of CMUK No. 1412, which must be implemented in accordance with Article. according to the article, it was decided unanimously on 07/12/2017 to OVERTURN the provision without examining other issues.
