Extension of Lease Agreements Subject to General Provisions

A key feature of fixed-term lease agreements subject to general provisions is that they terminate at the end of the specified term. However, the landlord must file an eviction lawsuit within one month of the expiration of this term or request eviction due to the expiration of the term.

Furthermore, if the tenant receives notice before the expiration of the term that the lease will not be extended, the lease cannot be extended, and the landlord may file an eviction lawsuit at any time after the expiration of the term.
If no such notice is given and there is an explicit agreement between the parties in the lease agreement that the contract will not be extended, and the tenant continues to occupy the premises while the landlord also continues to lease the property, the fixed-term lease agreement converts into an indefinite-term lease agreement (i.e., it becomes a lease agreement with an indefinite term).

To file a lawsuit regarding an indefinite-term lease, the lawsuit must be filed in accordance with the notice periods for termination.
If the lease agreement contains a notice requirement regarding the extension of the lease term and the parties have not fulfilled this notice requirement, the lease agreement is extended for the duration specified in the agreement.
Extension of Residential and Commercial Lease Agreements

The situation is slightly different for residential and enclosed commercial premises leases. In fixed-term lease agreements, if the tenant does not provide notice of termination 15 days prior to the agreement’s expiration, the agreement is extended for another year under the same terms.

However, it is not possible for residential and enclosed commercial premises leases to become indefinite upon the expiration of the contract term.

In certain rental areas, it is possible to lease a commercial space with a residential roof on an indefinite basis.

Extension of Product Lease Agreements

As mentioned above, a fixed-term lease agreement terminates at the end of the term. The landlord must file an eviction lawsuit within one month of the term’s expiration or make an additional request for eviction due to the expiration of the term.
Furthermore, if the tenant has received notice that the contract will not be extended prior to the expiration of the specified term, the contract is not extended. After the term expires, the landlord may file a lawsuit at any time.
If there is no explicit agreement between the parties that the lease will not be extended, and the tenant continues to occupy the premises while the landlord continues to rent it out, the fixed-term lease agreement is automatically extended for another year under the same terms.

To file a lawsuit during the extended term, the lawsuit must be filed in accordance with the notice periods for termination.
If the lease agreement contains a provision requiring notice of extension and the parties have not fulfilled this notice requirement, the lease is extended for the same duration specified in the agreement.
