INSTRUCTIONS
1-) My client has stated that the payment order in the enforcement file was sent on /…/….
2-) However, my client did not come to the Enforcement Office and file an appeal until the last day of the appeal period…/…/…. My client has been under observation in the hospital for a month due to a traffic accident he was involved in. The doctor’s reports regarding my client’s hospital stay and health condition are included in the annex, as they are from October.
3-) The debt pursued by the creditor was paid by my client in two installments in October, and samples of the payment receipts are attached. This enforcement proceeding was initiated because my client was unable to obtain the shares related to the debt after the payment. Therefore, we object to the debt.
4-) Since my client paid the debt subject to this enforcement case and could not file an appeal within the legal time limit, it was necessary to file a deferred appeal with your court.
LEGAL GROUNDS: 2004 PK m. 65 and related legislation.
LEGAL EVIDENCE: Payment receipts, doctor’s reports, witness statements, and other evidence.
CONCLUSION AND REQUEST
