Defense Application in Case of Defendant's Loss

… TO THE COURT

DEFENSE ATTORNEY (FUGITIVE):

ATTORNEY:

CHARGE: Offense of insult

SUBJECT: Defense statement.

EXPLANATION

My client, the defendant, is being sued on the grounds that he insulted the plaintiff. My client had never seen the plaintiff before the day of the incident. He went to the office at the gas station located at … to pay by card.

He saw the plaintiff there for the first time;. The plaintiff was buying cigarettes and water. He was so drunk he could barely stand. The plaintiff threw up on my client. My client, whose favorite clothes were stained, said, “God damn it.” This statement was never directed at the plaintiff; it was a personal complaint.

The drunk plaintiff then swore at my client and walked towards him. Although my client is a former licensed boxer, he did not hit the plaintiff; instead, he picked him up and told him to behave himself. The gas station manager and employees, who witnessed the altercation, then intervened and escorted my client to his car.

After leaving the scene, my client later learned that this lawsuit had been filed. The problem here is not my client, but the plaintiff himself. Furthermore, my client reserves the right to sue the plaintiff for insulting him and damaging his clothes.

OUTCOME OF THE CASE: We request that the lawsuit filed against my client be dismissed for the reasons stated above. …/…/…
