
What is Deportation?
A foreign national who is subject to a deportation order to their own country, a country they are transiting through, or a third country is permitted to leave.
The foreign national subject to the deportation order, or their legal representative or lawyer, is notified of the deportation order along with its legal grounds.
The foreign national or their legal representative or lawyer may appeal the deportation decision to the competent administrative court within fifteen days of the date of notification of the decision.
Provided that the foreign national consents, the foreign national shall not be deported during the period for filing a lawsuit or, if they have appealed to the courts, until the trial is concluded.
How is the deportation penalty lifted? How is the fine paid?
Foreigners who are prohibited from entering our country due to deportation proceedings must complete certain procedures if they wish to return to our country during the period of prohibition.
The necessary investigations are carried out for legitimate requests other than tourist visas (e.g., tuition fees, family reunification, appearing in court, rehabilitation, acquisition of real estate, etc.) and are finalized in accordance with (e.g.).
Who is Subject to the Deportation Decision?
Foreigners who are deemed to be subject to deportation in accordance with Article 59 of Law No. 5237,
Foreigners who are leaders, agents, or supporters of terrorist organizations, or leaders, agents, or supporters of criminal organizations for profit,Regarding foreigners who use false information and forged documents in entry, visa, and residence permit procedures in Turkey,
Regarding foreigners who earn their living through illegal means while in Turkey,
Regarding foreigners who pose a threat to public order, public safety, or public health,
Foreign nationals who have exceeded their visa or visa exemption period by more than ten days or whose visas have been revoked,
Foreign nationals whose residence permits have been revoked,
Foreign nationals who have a residence permit and who, without a valid reason, have exceeded the residence permit period by more than ten days after its expiration,
Foreigners found to be working without a work permit,
Foreigners who violate decisions regarding legal entry into or legal exit from Turkey,
Foreigners found to have entered Turkey despite being subject to an entry ban into Turkey,
Regarding foreigners whose international defense request has been rejected, whose international defense has been deemed inadmissible outside of the application, whose application has been rejected, whose application has been deemed withdrawn, or whose international defense has ended after the final decision of the law, and who do not have the right to stay in Turkey according to other decisions,
Regarding residence permit extension applications rejected for foreigners who do not leave Turkey within ten days,
Regarding foreigners assessed to be associated with terrorist organizations defined by international institutions and organizations,
(2) At every stage of international defense proceedings concerning persons who have applied for international defense or who have international defense status, a decision may be made to deport persons deemed to fall under paragraphs (b), (d), and (k) of the first paragraph of this article.
What is a Call to Leave Turkey?
Foreigners who have been issued a deportation order must leave the country (exit permit) unaccompanied by law enforcement authorities and apply within the period specified in the deportation order, which must be at least 15 days but no more than 30 days. Foreigners who are called upon to leave Turkey cannot apply for a residence permit or work permit during this period.
Which Foreigners Cannot Leave Turkey?
These procedures do not apply to foreigners who have legally entered and exited the country, those who have legally left the country, those who have used false documents or attempted to obtain entry permits with false documents, or those who are members or supporters of terrorist organizations or members of criminal organizations that threaten public order, public safety, or public health.
Which Foreigners Will Not Be Deported?
Foreigners who face serious indications that they will be subjected to the death penalty, torture, inhuman or degrading punishment or treatment in the country to which they will be deported,
Foreigners whose travel is at risk due to serious health problems, age, or pregnancy,
Foreign nationals who cannot be treated in the country to which they will be deported while undergoing treatment for life-threatening illnesses,
Victims of human trafficking who are benefiting from the victim support process,
Foreign nationals who are victims of psychological, physical, or sexual violence shall not be subject to a deportation decision until their treatment is completed.
These individuals may be required to reside at a specific address and report as requested.
Separately;
Foreigners whose visas or residence permits have been revoked and who voluntarily arrive at border gates to depart within 10 days,
Foreigners who have overstayed their visa or visa exemption period by more than 10 days and who voluntarily arrive at border gates to depart,
Foreigners whose residence permit applications have been rejected and who are using their visa or visa exemption periods,
who voluntarily come to the border gates to leave the country, those who have violated their residence permit period for more than 10 days without an acceptable reason after the end of the period,
Foreigners whose residence permit extension applications have been rejected, who have not left Turkey within 10 days of voluntarily coming to the border gates to leave the country,
Foreign nationals who withdraw or are deemed to have withdrawn their international protection application, foreign nationals who wish to return to their country by declaring in writing that they waive their right to appeal, International protection, voluntarily
withdrawing or having withdrawn their protection application, declaring in writing that they waive their right to appeal, and in accordance with other provisions of the Law ,
It deals with foreigners who have the right to stay in Turkey.
Until a clear decision is made by the court, no decision to deport foreigners who have applied for accelerated assessment and whose international protection applications have been rejected will be made.
Foreigners wishing to enter our country and foreigners who are required to leave our country must enter/exit through our open border gates with a valid passport or documents serving as a substitute for a passport.
Foreigner departing from our country who do not have a valid passport or passport substitute document with them may depart by obtaining documents (such as a passport or travel document) from their own diplomatic missions.
Foreigners entering/exiting our country must present their passports or documents serving as passports and other documents to the officials during entry/exit.
Border Investigation
If there is suspicion that a foreigner is one of the persons who will not be allowed to enter our country, law enforcement authorities may conduct a detailed investigation of foreigners entering our country. During this investigation, the foreigner’s situation is investigated, and this investigation is completed within four hours at the latest. This period does not include the time spent on legal proceedings. If the four-hour period is exceeded, the foreigner’s consent is obtained. Within the scope of the extended control period, the foreigner may return to their country and wait for the completion of the entry procedures.
Foreign nationals identified as being among those who will not be permitted to enter our country are deemed inadmissible passengers. Necessary notifications are made, and coordination with the carrier company is ensured for departure procedures to facilitate the removal of these foreign nationals from our country.
Foreign Nationals Who Will Not Be Permitted to Enter Our Country
Those who do not have a passport, a document serving as a passport, or a work permit, visa, or residence permit obtained by fraudulent means, as well as those who do not have a valid passport or document serving as a passport that is at least sixty days valid prior to the expiration of the visa, visa exemption, or permit period, are prohibited from entering the country.
Thos who are considered dangerous to public safety, public order, or public health; those who have a disease that is considered a threat to the Republic of Turkey; those who are exempt from crimes they are a party to under agreements or crimes for which their return is important, or those who are found to be the cause of the return of criminals; those who do not have valid health insurance covering their period of stay in our country. those who cannot justify their desire to enter, leave, or remain in Turkey,
those who do not have sufficient and regular financial means during their stay, those who do not have permission regarding the collection of public debts arising from a previous session or visa violation, or those who have received a non-prosecution decision dated 21/7/1953 and numbered 2823, published in the Official Gazette and who have received a non-prosecution decision under Law No. 6183 dated 26/9/2004 and published in the Official Gazette dated 2008/108 … 26/9/2004, and who accept to pay later and do not return to our country, will not be allowed to enter.
