INSTRUCTIONS :
1-) My client is a suspect and was arrested on../…/….. In accordance with the arrest warrant issued by your court on the above-mentioned query file.
2-) Considering my client’s statements and the evidence available in the file, it will be clearly seen that the material and moral elements of the crime committed by my client have not occurred.
3-) Furthermore, the conditions stipulated in Article 100 of the Code of Criminal Procedure No. 5271 for my client’s arrest have not been met. First of all, there is no ‘strong suspicion’ that the act in question was committed by my client. Furthermore, my client is a business owner, tradesman and artisan, a well-known person with a family and a fixed residence. Furthermore, there is no possibility of fleeing and/or attempting to remove or conceal evidence during the investigation phase.
4-) For the reasons explained above, we object to the above-mentioned arrest warrant.
