SUBJECT: Claim for compensation regarding name protection.
EXPLANATIONS:
1-Our client is a well-known and beloved merchant in his community. Due to his nature, our client is not very sociable and is known. For his calm personality.
2-A neighbor, annoyed by our client’s indifference, named his dog after our client and had the name written on the dog’s collar with the intention of drawing attention and provoking our client.
3-The defendant walks his dog in the garden where a large group of people sit and chat during the busiest hours of the neighborhood and often calls his dog by our client’s name.
4-Our client feels hurt and humiliated by the defendant’s behavior.
LEGAL BASIS: MK.m.25, BK.m.49 and 41.
EVIDENCE: Witnesses, Population Records, Witness Statements, and All Types of Evidence.
RESPONSE PERIOD: 10 days
CONCLUSION: For the reasons stated above, we request that the defendant be ordered to cease this action that has caused harm to our client, that the defendant be ordered to pay our client ……. in compensation, that the defendant be ordered to pay compensation, that the costs of the proceedings be borne by the defendant, and that the opposing party’s attorney’s fees be paid to us as a retainer in accordance with the last paragraph of Article 164 of the Attorney’s Act No. 1136, as amended by Act No. 4667.
