Family Residence Permit in Turkey
Family residence permit is regulated in Articles 34 to 37 of the Law on Foreigners and International Protection numbered 6458. In addition, family residence permit is regulated in Articles 30 to 34 of the Regulation on the Application of the Law on Foreigners and International Protection.
Who are the Foreigners Who Can be Granted a Family Residence Permit?
Citizens of the Republic of Turkey, those who are within the scope of Article 28 of Law No. 5901 or foreigners who have one of the residence permits, as well as refugees and holders of secondary protection status;
a) Foreign spouse,
b) Himself or her or her spouse’s non-adult foreign child,
c) To a foreign child whom he or his spouse is responsible for
family residence permit may be granted.
If the foreigner requesting a family residence permit has more than one spouse, only one of the spouses may be granted a family residence permit. However, family residence permit may be granted to all children of the foreigner.
If a request is made for a family residence permit for children located outside our country, the consent of the mother or father who has the right to joint custody is sought.
The family residence permit provides the right to study at primary and secondary educational institutions until the age of eighteen without obtaining a student residence permit.
How Many Years Can a Family Residence Permit Be Granted?
-Family residence permit can be arranged in such a way that it does not exceed three years at a time.
-The duration of the family residence permit cannot exceed the duration of the sponsor’s residence permit in any way.
What are the Necessary Conditions For a Family Residence Permit?
In order to be granted a family residence permit, foreigners must meet the conditions specified in Article 35 of the Law.
To fulfill the conditions required by the promoter,
(Valid health insurance of the sponsor covering the whole family, Monthly income per capita should not be less than a third of the minimum wage, Certification that the family has committed a crime contrary to the order in the last five years, residence in Turkey for less than a year and registration in the registration system)
Those who request a family residence permit must meet the conditions they request to stay with the applicant,
(Submission of supporting information and documents related to the purpose of stay in our country, indicating that he lives or intends to live with the specified persons, that the spouses have reached the age of eighteen, that the marriage is not within the scope of Article 7 of the said Law, that the marriage was not performed for the purpose of obtaining a family residence permit)
What are the Reasons for Refusal, Cancellation or Non-Extension of Family Residence Permit?
– Failure to meet or disappearance of the conditions required for a family residence permit,
Determination that the family residence permit is used outside the purpose of issuance,
– A valid deportation or entry ban decision has been taken against him
in case the family residence permit has not been granted, if granted, it has been cancelled, the expired ones have not been extended.
