SUBJECT : It consists of a request for cancellation of the exit from the inheritance.

1-) Our client’s late father … …, …/…/…. He died as a result of a traffic accident in his history. (Oct 1)
2-) Our client has been disinherited in accordance with the will filed in front of our client and other heirs on the date of …/…/…. In the will, the fact that our client is married to and has joint children despite all the objections of the inheritor is shown as the reason for disinheritance.
3-) 510 of the Turkish Civil Code numbered 4721. In its article, it is stipulated that the heir may be removed from the inheritance if he commits a serious crime against the inheritor or one of the relatives of the inheritor, or if the inheritor does not fulfill his obligations arising from family law against him or the family members of the inheritor in a fundamental way. The reason put forward in the Decrees is not among the reasons listed in the law. Our client has not committed a crime against the inheritor or his relatives and has not violated his obligations. Our client, who maintains his relations with the inheritor despite all his negative approaches, also has a very close relationship with other members of the family and fulfills the responsibilities that come with being a family.
4-) Due to the reasons explained above, it has become necessary to apply to your court for the cancellation of the removal regulation contained in the will issued by the legatee.
