Finalization of the Debt in the Execution Proceedings

In the enforcement proceedings without a warrant initiated through general foreclosure, the enforcement proceedings are stopped if the debtor notifies the pay order sent to him by the enforcement department of his objection within 7 days. If no objection is made within the objection period, the pay order and enforcement proceedings will be finalized.

In the enforcement proceedings without a decision filed through general foreclosure, the rightness or unfairness of the debtor in objecting to the debt is not investigated. Enforcement proceedings shall stop with the objection. In order to eliminate the debtor’s objection and continue the enforcement proceedings for the collection of the receivable, the creditor must file a lawsuit for the cancellation of the objection in the Enforcement Court within six months or for the cancellation of the objection in the general courts within one year. This period begins with the notification of the debt objection petition to the creditor.

The Period of Finalization of the Execution Procedures

Unlike enforcement proceedings, there can be no objection against a receivable subject to enforcement. The debtor may request a stay of execution by applying to the enforcement court within 7 days from the notification of the executive order for reasons such as “payment of the debt, postponement of the debt, expiration of the time limit for the payable” under certain conditions. Unlike an appeal, the execution does not stop on its own with a request to stop. If pay, postponement, or statute of limitations has occurred after notification of the executive order, the request for termination is not subject to the time limit. Unlike non-enforcement pursuit, a court order is required to stop the pursuit.

The debtor may object to the debt, authority and signature within 5 days from the date of notification of the pay order to him; however, the objection to the signature must be made clearly and separately, unlike other objections, otherwise no valid objection to the signature will be made.
