The degree of disability is decided by the Social Security Institution (SSI) Health Board and the disability pension is connected according to this decision. Upon the request of the SSK, the insured, who has been determined by the SSI Health Board that the hospitals authorized by the SSI have lost at least 60 percent of their working power as a result of the reports duly organized by the health board and the examination of the underlying medical information, is considered disabled and retired by disability and is connected monthly.
It seems that the report rating received from the health board of the referred hospital is usually lowered by the SSI Health Board. As a matter of fact, if you have not been invalidly retired because your report rating has been reduced, you can use your right to appeal against the SGK Health Board’s report. When your appeal is concluded, if your degree of disability is not changed and you are not retired, you can file a lawsuit with the Labor Court. According to the report you will receive from the hospital appointed by the court; the court decides your degree of disability. And if the court decides that you have suffered a labor loss of 60 percent or more, you can retire with a disability.
