As a rule, these are jointly guaranteed by the Constitution of the Republic of Turkey and the European
Convention on Human Rights, along with the protocols to which Turkey is
a party.
Individuals who claim that any of their fundamental rights and freedoms have been violated by public authorities
may file an application.
It is important that the country in which the individual application is made is a party to the convention.
Foreign nationals have the right to make individual applications.
However, foreigners cannot make individual applications regarding “rights granted only to Turkish citizens” – such as the right to vote and be elected.
Public legal entities cannot make individual applications.
Private legal entities (unions, associations, foundations, commercial partnerships, etc.) can only make individual applications regarding violations of their legal personality rights.
Public legal entities cannot file individual applications. Private legal entities (unions, associations, foundations,
commercial partnerships, etc.) may only file individual applications on the grounds that
their legal personality rights have been violated.
