An age correction lawsuit is a lawsuit filed in the court of first instance if the identity age of a person differs from his or her actual age. Basically, we can call it a kind of population correction case. With the age correction case, various medical, biological and physiological data are examined and reported by experts, concrete facts revealed by evidence such as witness statements are evaluated by the judge, and if the court decides that the identification age is incorrect, it has been decided to change the date of birth registration in the population registers and therefore the age, due to the fact that it does not reflect the actual age.
The fact that the information contained in the population records does not reflect the actual situation is mostly related to the date of birth and, accordingly, age. Until recently, especially in rural areas, children were registered late or early in the population, or they were registered with other siblings, which may not reflect their actual age. These mistakes cause some problems in people’s lives.
For example,
a person may register his/her child’s age early in order to be able to perform some license procedures, but sometimes he/she may not be able to take the exam due to the upper age limit when he/she reaches an advanced age. Because I took some exams. In addition, as a current issue, people whose real ages were not recorded in the population register in terms of benefiting from military service were having problems and could not benefit from military service. For reasons such as these, the age change case is extremely important.
Article 218/2 of the Code of Criminal Procedure No. 5271 states: “If there is a problem in determining the age of the victim or the accused in terms of criminal provisions during the prosecution phase, the court will resolve this problem according to the procedure established in the relevant law and make its decision.” In accordance with this provision, the legislator has given the criminal courts a special authority to make age correction during the prosecution phase.
