What is notice pay
The employee whose employment is terminated as a result of a dispute between the employee and the employer for various reasons has a number of rights. One of these rights is notice pay.
In indefinite-term employment contracts and if the employee or employer terminates the contract without any just cause and without showing evidence and without complying with the periods determined according to the relevant article of the Labor Law No. 4857, the compensation that the terminating party is obliged to pay, the payment made to the other party is called the notice payment.
Article 17 of Labor Law No. 4857 states when notice period will start as follows:
An employee whose service period is less than 6 months: 2 weeks (14 days)
Employee with 6 Months to 1.5 Years of Service: 4 Weeks (28 days)
Workers with 1.5 to 3 Years of Service: 6 Weeks (42 days)
Workers with more than 3 years of service: 8 Weeks (56 Days)
Party that fails to comply with these deadlines must pay other party advance notice pay.
