What are the Conditions for the Withdrawal of the Disclosure of the Provision

a) The sentence imposed at the end of the trial for the crime committed on the accused is a prison sentence of 2 years or less or a judicial fine,

b) The defendant has not previously been convicted of a premeditated crime,

c) The court concludes that the accused will not re-commit a crime, taking into account his personality traits and attitude and behavior at the trial,

d) Complete elimination of the damage (if any) suffered by the victim or the public during the commission of the crime by exactly returning it, making it prior to the crime, or compensating it,

e) The defendant’s express acceptance of the withdrawal of the explanation of the provision,

if the conditions are met together, the court may decide to leave the explanation of the provision undone.
